The Senate Bill 123 (SB 123) program was established by K.S.A. 21-6824, which was approved during the 2003 Legislative session and implemented in fiscal year 2004 with the goal of providing substance use disorder (SUD) treatment to people convicted of non-violent drug offenses. In 2019, SB 123 was broadened to allow some people convicted of a controlled substance cultivation or distribution offense to qualify, and in 2023 SB 123+ took effect allowing certain people convicted of non-drug, non-person offenses to qualify. These programs provide funding to eligible individuals for community-based SUD treatment for up to 18 months while they are under community corrections supervision. Treatment is furnished by providers state-wide who are licensed by the Kansas Department of Aging and Disability Services and certified by the Kansas Sentencing Commission. The programs are maintained through coordinated efforts among the Kansas Sentencing Commission, Community Corrections, Court Services, and certified treatment providers. Since it’s inception, SB 123 has provided over $130 million in assessment and treatment services for qualified participants.
Goal
To provide community intervention and the opportunity for treatment to certain people with substance use disorders to address more effectively their recidivism in the state prison system.
